For many years in the state Florida the injured worker had no choice in what provider they were able to use when injured on the job. However, a recent ruling of the Florida Supreme Court changed the environment in favor of the injured worker’s access to treatments that have  previously denied by insurance companies.

If you have injured your neck or back at work and you are not currently seeing a chiropractor for these injuries you may not receiving the treatment that is best suited to properly resolve your condition.  Chiropractic is the best choice for many injured workers, especially with regards most neck and back injuries.  Chiropractic has several advantages over other treatments:

1. Chiropractic is non-surgical.

2. Chiropractic is drug free.

3. Chiropractic care must be covered by all workers’ comp carriers in the state of Florida.

4. Chiropractic is safe.

5. The techniques used by chiropractors have been shown to help low back pain, neck pain, lumbar and cervical disc herniations and radiculopathy (numbness and tingling into the arms or legs) in numerous scientific studies.

6. Chiropractic is often the quickest and most effective treatment for low back pain.

7. Chiropractic results cannot be replicated by any other profession.

If for some reason you are being excluded from chiropractic care you may want to visit a chiropractor who can assist you with getting authorization for treatments.  This is a common practice with injured workers and is usually obtained following a brief examination with the chiropractor.  The chiropractor must be able to identify the injury and articulate to the insurance company what the injury is and how chiropractic care could help.

Tips for the injured worker:

• If you are injured you have 30 days to report your injury to your employer.

• Once your employer has been notified they must report the injury to their insurance company within seven days.

• The insurance company must send you an informational brochure within three days after receiving notice from your employer. The brochure will explain your rights and responsibilities, as well as provide additional information about worker’s compensation law.  A copy of this brochure can be seen at myfloridacfo.com under “publications”.

• If your employer will not report your injury to the insurance company you have the legal right to report the injury directly to the insurance company. However, if you need assistance contact the employee assistance office at 800-342-1741 or email [email protected].

• In order to get medical treatment the medical provider must be authorized by your employer or the insurance company.

• You do not have to pay any medical bills that result from treatment of a work injury.
